Hello everyone. Kids are still up, so I'll be here sporadically.

Speaking of kids, my 4yo told me today that he had lots of little balls bouncing up and down in his feet. I had to stop and think for a moment, and then decided he must have pins and needles. He said yes, they felt like needle balls. I just had to write that down somewhere before I totally forgot. :)

It follows one from your discussion earlier today. The first post on the thread sets the scene, but the advice that follows is also important. Anyway, here's the first post on the thread:

What would an American company have to do to stop a foreign website from using its images? My personal situation is that a New Zealand based website is using a large number of images taken from an American website. I'd like to know if they legally able to get away with this, and what the American website could do legally to stop the New Zealand site using its images.

fm - in some situations there are technical measures that can be employed as well. If someone has copied an image and has hosted it on their own server, then they would have to resort to law and threaten/take legal action to have them removed, assuming the images are under copyright. If they are linking to images on their server and hence utilising bandwidth, it can be relatively easy to change the configuration of the web server to only serve images to web pages that are linked from chosen web servers. You can then cause image not found errors, or even seed your own images to have some fun... mwahahaha. But is is much more difficult when the images have been rehosted elsewhere, say flickr.

Yeah Bernard, I've always thought it's pretty poor form to display someone's image using their link. I've always thought it better to host the image yourself and these days, it's pretty easy to do using blogger images or flickr. Having said that, I wouldn't normally dream of it if it's an image which is obviously being used for commercial gain (like a newspaper article or a commercial photographer), the difficulty being identifying what is "in the public domain". Tricky territory indeed.

I needed a Barbie picture for effect, for my Barbie joke today.

So I googled to find a blond in lingerie (on a site advertising lingerie), saved the picture and loaded to my site, and made a hyper link of the picture back to the site I found it on, which technically references the site and may even send business their way.

I'm not trying to take advantage of their photos for commercial gain, and a reference has effectively been provided. I didn't notice a copyright notice anywhere, but I may have been a little distracted.

I figured linking was fair.

Have I done the right thing, or is there better etiquitte to follow? It seems insane to write an email asking for permission to use the photo for a 5 minute post of a joke about Ken and Barbie...

Just read that link fm. Very interesting. I'll be sure to pay a bit more attention to the images sent to me, that I store away and eventually like to use to brighten up my site.

Some have a logo stamped on, and I make a point never to remove those, so that the source web site might get visits, but maybe that's not enough.

I have no idea where some of my images, jokes and quotes originate from, as they do the rounds. That might be a bit of a problem.

Hopefully, any-one so offended at inadvertent "plagiarism" would first write a polite "cease and desist" email.

Zen, what you've done with Ken and Barbie is exactly what I would have done to try and be as fair as you possibly can (short of not using it). I mean, sometimes commercial sites actually want the "Internet buzz", so it's hard to tell if you're offending anyone sometimes. Most of this is simple blogger etiquette, but someone with a mean streak and a law degree (and perhaps a political agenda) could make things very nasty indeed.

Thanks for that fm. I got distracted at a site called "Left and Lefter". The left wing logic presented in a fable (competition is bad. Don't try to win, just walk) proved too much and I had to do a post on Zen State.

Putting the post direct on Sir Humphs might generate too much flak for the left and lefter site, and never let it be said that I don't have compassion...

..and I'm pretty sure only a handful of people actually read the comments on SH....
