Keysgate! John Key's garbage rifled?

Don Brash's computer will likely be examined by forensic computer experts for hints as to the origin of the leaked emails, and John Key's neighbours report his rubbish was examined by men 'wearing suits':
Finance spokesman John Key said yesterday that neighbours had reported seeing men rummaging through rubbish bins outside his $8 million Parnell home. "They weren't hobos. They were people dressed in suits as I understand it. And they're obviously not looking to get scraps of food.

"I assumed it was people looking for confidential documents, like our tax policy. But I've been pretty careful."

At least two such incidents had been reported to him by neighbours, one about six weeks ago and another a month before that.
Is that sort of goings on legal in New Zealand? I guess it depends on whether the garbage cans were sitting on public property of Keys' property. Either way its revolting behaviour. And there's still three weeks to go.

Nope, thats why you're very careful about how you dispose of your trash. Even for the average person, trashing is a great way to perpetrate identity theft - let alone securing some interesting information.

The hours suck and the pay bites.

But I think this sort of thing would go down badly with the gp. I say time to name a source. Without a source this is another Dan Blather story.

With a source we get to see who is playing the dirty game and decide if thats who we want on the 9th floor.

This is an interesting situation legally.

If John Key or someone in his household has taken the trash out and left it outside his home then he is said to have abandoned it, so that it cannot technically be stolen.

If someone however goes through the trash thereafter wanting to find personal information about him without his consent then that would be an offence under the privacy act.

Most likely they would also be in breach of the health act and local by-laws concerning waste disposal.

There has indeed this case in the United states with the paparazzi going through celebrities' trash. The celebrities won, but the verdict was so wishy washy that they now dispose of their waste through private contractors.

I don't know of any NZ or Common Law test caes or precedents off the top of my head, so that is why I say it is all rather grey.

The trash belongs to the city or county that the trash is located in. This is why it is good to have a shredder, or put the cat shit and sour milk in with the trash.

Perhaps he should lend them a video camera or one of the new fancy video phones for next time put out some sensational bullshit with the rubbish so he can debunk it when it is 'leaked'

Hehe, it seems there is a bit to be said about security recently. Emails and trashing, I wonder how long before we get a security breach from a key logger, or open wireless network...
